WEVolunteer - Terms of Use

WEVolunteer.ca (“WEVolunteer”) is a free online Service (“Service”) provided by United Way/Centraide Windsor Essex County (“United Way”), their staff and volunteers. The Service is available to both members of the public seeking volunteer opportunities and to voluntary sector organizations promoting volunteer opportunities to potential volunteers. Access to WEVolunteer and use of the Service for all users is subject to agreement to the following Terms of Use (“Terms”).

Agreement to Terms

Please read the Terms carefully before accessing or using the Service. By accessing or using the Service, you agree to be bound by these Terms. The Terms and the Service, as well as any information contained herein, may be updated or revised from time to time without notice to you. Your continued access to or use of the Service shall constitute your acceptance of the updated or revised Terms.

Registration and Contact Information

Those persons seeking volunteer opportunities are required to register by providing your e-mail address and telephone number. Voluntary Sector Organizations are required to register by providing information regarding the organization including contact information. All information collected will be handled in accordance with our Privacy Policy.

No Liability

Under no circumstances will WEVolunteer or the United Way be liable for any consequence relating directly or indirectly to any action or inaction you take based on the information, services or other material provided by the Service. While WEVolunteer and the United Way will attempt to keep the website current, accurate, and complete, WEVolunteer and the United Way and its suppliers cannot guarantee, and will not be responsible for any damage or loss related to, the timeliness, accuracy, or completeness of the information, Services, or other material through the Service.

Site Conduct

When using the Service you agree to abide by the following rules:

(a) You may not post or transmit content (information, data, text, software, graphics, sound, photographs, video, messages, etc.) (“Content”) that is unlawful, harassing, libelous, defamatory, obscene, fraudulent, harmful, threatening, abusive, hateful, that violates the property rights of others (including without limitation infringing the use of any copyright or trademark), that violates the privacy or publicity right of others, or are otherwise objectionable.
(b) You may not interfere with other users’ use of the Service.
(c) You may not use the Service to conduct any activity that is illegal or that violates the rights of others.
(d) You may not use the Service to advertise or sell products or services to others. 
(e) You may not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
(f) You may not post or transmit Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, confidential information, etc).
(g) You may not post Content unless the Content is freely owned by you or used with the permission or all other person with any rights in the Content. 
(h) You may not use the Service to collect or store personal data about other users.

Internet Links

The Service may provide, or third parties may provide, links to other internet sites. WEVolunteer and the United Way has no control over such sites nor do they endorse or can they be held liable for any such sites or the information, material, products or services contained on or accessible through those sites. You acknowledge that WEVolunteer and the United Way shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance upon any such information, material, products, or services.

Third Parties

At times there may be postings regarding third parties on the Service. WEVolunteer and the United Way will endeavor to check the validity of these postings but make no claim as to the accuracy of the representations being made by the third parties, and further, provide no warranty, guarantee or representation respecting the third party postings. The third-party information is not necessarily sponsored, endorsed, recommended, or licensed by WEVolunteer or the United Way. The third parties should be contacted directly to verify the accuracy of their postings and content. Your correspondence or business transactions with, or participation in promotions of, third parties found on, or e-commerce conducted through the Service and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. You agree that WEVolunteer and the United Way shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such transactions or as the result of the presence of such third parties through the Service.

Indemnification

You agree to indemnify, defend and hold harmless WE Volunteer and the United Way, its affiliates, governing board, officers, agents, employees, partners, funders and suppliers from any liability, loss, claim, demand, and expense (including reasonable attorneys’ fees) related to:
(a) Your use of the Service.
(b) Your violation of these Terms.
(c) Your posting or Content to the Service.
(d) Claims for damage or injury resulting from participation as a volunteer in a volunteer opportunity acquired through the site.

Modifications to Site

WEVolunteer and the United Way reserves the right to, from time to time, discontinue either temporarily or permanently, the Service with or without notice.

Use and Storage of Content on the Site

WEVolunteer and the United Way may establish general practices and limits concerning the use of the Service, including without limitation, the maximum number of days that Content will be available on, or retained by the Service. WEVolunteer and the United Way, in their sole discretion, reserves the right to change these general practices and limits at any time.

Disclaimer of Warranty

You expressly understand and agree that the Service and all related information and Content, is provided on an “as is” and “as available” basis. WEVolunteer and the United Way and its information suppliers disclaim all express and implied warranties with regard to the Service and all information, services, and materials available through the Service including without limitation any implied warranties or merchantability, fitness for a particular purpose, and non-infringement.

WEVolunteer and the United Way make no warranty that:
(a) The Service will meet your requirements or that the results that may be obtained from the Service will be satisfactory.
(b) The Service will be uninterrupted, timely, secure, or error free.
(c) The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectation. (d) The Service will be error free.

No advice or information, whether oral or written, obtained by you from WEVolunteer and/or the United Way, or through the Service shall create any warranty not expressly stated in the Terms.

Limitation of Liability

In no event shall WEVolunteer and/or the United Way, or its affiliates, governing board, officers, agents, employees, partners, suppliers, funders or volunteers be liable for any special, indirect, punitive, incidental, exemplary or consequential damages, or any damages whatsoever resulting from loss of use, business, data, or profits, litigation and the like, whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. You acknowledge and agree that the limitations set forth above are fundamental elements of these Terms and that the Service would not be provided to you absent such limitations. If any jurisdictions do not allow the foregoing limitations of liability, the foregoing limitations may not apply to you.

Termination

WE Volunteer and the United Way may, in their sole discretion, with or without notice, suspend or terminate your use of this Service and remove and discard any Content available through the Service for any reason, including, without limitation if you violate these Terms. WEVolunteer and the United Way may also prevent you from any future access to the Service. WEVolunteer and the United Way will not be liable to you for any such suspension, termination or prohibition on future access. Should you object to any subsequent modifications of the Terms, your sole recourse will be to immediately notify WEVolunteer of your termination of these Terms, which termination will be effective immediately. To the extent permitted by applicable law, the terms and conditions of these Terms will survive any termination of these Terms.

General Provisions

These Terms constitute the entire agreement between you and WEVolunteer and the United Way and govern your use of the Service, and supersede any prior agreements between you and WEVolunteer and/or the United Way regarding the Service (including, but not limited to, any prior versions of these Terms). These Terms and the resolution of any dispute related to these Terms or the Service should be governed by and construed in accordance with the laws of Canada, without giving effect to any principles of conflicts of law. WEVolunteer and/or the United Way’s failure to insist upon strict enforcement of any provision of these Terms shall not be construed as a waiver of any provision or right. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will be enforced in accordance with their terms. The section headings in these Terms are for convenience only and have no legal or contractual effect. Regardless of any statue or law to the contrary, you hereby waive your right to bring any claim against WEVolunteer and/or the United Way more than 1 year after such claim first arose.

Privacy Policy

The United Way as the primary sponsor of WEVolunteer, respects your privacy. Any personal information you provide to us; including your name, address, telephone number, and e-mail address, will not be released, sold, or rented to any entities or individuals outside of WEVolunteer or the United Way unless you provide your express permission to do so.

WEVolunteer shares web site usage and generic statistical information about visitors with their membership and in general with reputable third parties for the purpose of securing operational funding. However no direct or personal information that can be associated with any individual is provided unless you so permit. At any time you may request to be removed from our electronic mailing list.

Disclosure to register volunteer opportunities

WEVolunteer and/or the United Way is under no obligation to verify the actual identity, qualifications, credentials, or other information relating to any person or organization seeking volunteers through the Service. WEVolunteer and/or the United Way is not responsible or liable to you or any other person for any information about person provided through the Service or for any errors or omissions regarding any verification or screening or person undertaken by the Service. WEVolunteer and the United Way are not parties to any agreement you may make with any person and/or corporation, organization or entity, and are not responsible or liable for any acts or omission by any person, including any unauthorized collection, use or disclosure of your personal information obtained through the Service.

By registering as a potential volunteer you are granting your consent to the collection, use, and disclosure of your personal information to those organizations that have promoted a volunteer opportunity that is of interest to you for the purpose of contacting you.

Personal information you will be specifically asked to provide during your use of the Service, includes, but is not limited to, your personal name, e-mail address, postal address, telephone number, fax number, age gender, educational level, occupation and a description of your skills and certifications. If you choose not to provide certain requested personal information, you will not be able to access or use certain features of the Service. WEVolunteer uses your personal information for the following purposes and as otherwise permitted by applicable law:
(a) To contact and correspond with you.
(b) To match you with potential volunteers or organizations seeking volunteers.
(c) To otherwise facilitate the provisions of the services available through the Service. WEVolunteer may also develop a confidential profile for you, which will be used to provide services to you and facilitate your use of the Service, and may keep a record of all communications with you. WEVolunteer may from time to time send e-mails and newsletters, or other communications containing information about WEVolunteer and matters that may interest you. At any time you may ask WEVolunteer to stop sending you e-mail, newsletters and other information.

Disclosure to Volunteer Organizations

As an organization, by registering to use the volunteer matching service available through WEVolunteer you agree to only use personal information for the purposes for which it is provided to you; specifically, to contact interested potential volunteers and strictly in accordance with all applicable laws. WEVolunteer and the United Way are not liable or responsible for volunteer organizations’ use and disclosure of personal information.
